OPINION AND ORDER
BROWN, District Judge.
This matter comes before the Court on Defendant’s Motion for Summary Judgment on Grounds that FGI, A Non-Carrier, Has Taken No Adverse Action (# 51). The Court heard oral argument on Defendant’s Motion on November 22, 2002. Plaintiffs’ Motion for Class Certification (# 45) also is pending.
