I. Introduction
On October 80, 2009, the trial court placed Appellant Gerardo Tomas Rivas on deferred adjudication community supervision after Rivas entered open pleas of guilty to possession with intent to deliver a controlled substance (cocaine) of one gram or more but less than four grams; possession of a controlled substance (psilocin) of 400 grams or more; and possession with intent to deliver a controlled substance (hydrocodone) of twenty-eight grams or more but less than 200 grams.
