Brin-Mont Chemicals, Inc. (Brin-Mont), Debtor-in-Possession, and the Duly Appointed Unsecured Creditors Committee (Committee) of the estate of Brin-Mont Chemicals, Inc. (Plaintiffs-Appellants) appeal an Order issued by the bankruptcy court. In its Order, the bankruptcy court granted Worth Chemical Corporation’s (Defendant-Appellee’s) Motion for Judgment on the Pleadings, ruling that the plaintiff’s avoidance action under 11 U.S.C. § 547 was barred by the two-year statute of limitations contained in 11 U.S.C. § 546(a)(1).
