OPINION
RODRIGUEZ, District Judge.
This case is presently before the court on a motion to dismiss pursuant to Fed.R. Civ.P. 12(b)(6) filed by defendant Midlantic National Bank/South (“Midlantic”).
On April 26, 1979 Metropolitan Metals, Inc. and Delta Metals, Inc. (“the debtors”) filed petitions under Chapter XI of the Bankruptcy Act of 1898 1 in the U.S. Bankruptcy Court for the Middle District of Pennsylvania (“the bankruptcy court”).
