OPINION
PETTINE, District Judge.
This is a civil equity action pursuant to Fed.R.Civ.P. 65 in which the plaintiff, a member of the United States Marine Corps, seeks an injunction prohibiting military authorities from subjecting him to an allegedly unconstitutional court martial. Jurisdiction is predicated upon 28 U.S.C. § 1331. On September 11, 1969 this court issued temporary restraining relief and requested extensive briefs from the parties on various questions of law.
