Appeal from a judgment of the superior court for Chelan county, Grimshaw, J., entered May 6, 1911, upon the verdict of a jury rendered in favor of the defendants by direction of the court, dismissing an action on contract.

Sometime in March, 1910, the respondents entered into a contract with E. D. Utter to build two cottages. Utter sublet the plumbing to the appellant. He failed, however, to pay appellant the agreed price for the *352plumbing, and appellant sought to obtain the amount due from respondents. It is alleged in the complaint that appellant was about to file a lien upon the property for the amount it claimed to be due, when an agreement was entered into between appellant and respondent J. T. Brown, wherein Brown did orally promise, in case appellant did not file its claim of lien, he would pay appellant…
