MATSUMOTO, District Judge:
Presently before the court is defendant Sovereign Bank’s (“defendant” or “Sovereign”) motion for summary judgment, pursuant to Federal Rule of Civil Procedure 56, seeking dismissal of plaintiff Faina Vinokur’s (“plaintiff’ or “Vinokur”) action.
