The appellee, Dexter Stanley, filed suit in the circuit court against Motors Insurance Corporation, appellant here, for the recovery of the actual cash value of a 1956 Model GMC truck, and alleged that a valid collision insurance contract had been issued to appellee by appellant, and on November 16, 1957, the truck had been damaged in a collision and was a total loss. Appellee alleged that he purchased the truck from a dealer, David T. Dotson, in 1956.
