LIPEZ, Circuit Judge.
This case requires us to decide whether a passenger’s state tort claim against an international air carrier was preempted by the Warsaw Convention 1 and therefore properly dismissed by the district court. For the reasons set forth below, vye vacate the district court’s judgment granting the motion to dismiss and remand for further proceedings consistent with this opinion.
