This appeal involves (1) a constitutional challenge to Article III, Section 3-3 of the County Charter for the County of Hawai'i (“Section 3—3”),1 which requires that a candidate for local public office be registered to vote in the district in which the candidate intends to run for at least ninety days before the primary election, (2) a claim that the appeal by the County of Hawai'i is moot, and (3) a claim that the Circuit Court of the Third Circuit (“Circuit Court”)2 lacked authority to consider the county clerk’s challenge to the candidate’s nomination…
