MEMORANDUM OPINION
KATZ, District Judge.
This matter is before the Court on Defendant’s motion for summary judgment, pro se Plaintiffs memorandum in opposition, and Defendant’s reply thereto. This Court has jurisdiction pursuant to 28 U.S.C. § 1331. For the reasons that follow Defendant’s motion is well taken.
