This case comes up on the following certified statement and questions from the Court of Civil Appeals for the First District:

“On August 13, 1856, J. A. Thompson was the owner of 1476 acres of land in Montgomery County. On that date he executed and delivered to Wm. R. Baker a conveyance to the land in the form of a general warranty deed, reciting a cash consideration of $1600. This deed was not placed of record until April 6, 1858. On November 14, 1856, J. A. Thompson executed and delivered to one J. W. Henderson as trustee a deed of trust upon the land in question…
