FACTS AND PROCEDURAL BACKGROUND

On October 18, 2000, Wayne Seward (Seward) fell off a ladder and injured his back in the course and scope of his employment with Pacific. At Pacific’s request, Seward saw Dr. Hill.

Dr. Hill referred Seward to Dr. Doerr, an orthopedic surgeon. Dr. Doerr ordered two MRIs for Seward. Neither MRI showed structural damage to Seward’s back. Therefore, Dr. Doerr referred Seward to Dr. Cox, a…
