Appeal by the plaintiff, Lena Crump, from an order of the Supreme Court, made at the Kings County Special Term and entered in the office of the clerk of the county of Kings on the 1st day of Hay, 1914, denying her motion for judgment on the pleadings.
1Per curiam
The present defendant, Wissner, was a conditional vendor, who, after default, took proceedings to foreclose his lien under section 139 of the Municipal Court Act (Laws of 1902, chap. 580, as amd. by Laws of 1910, chap. 542). Under a warrant of seizure in that proceeding, the chattel was taken and held by a city marshal. A judgment was recovered after personal service on the vendee, Lena Crump, in favor of the vendor, and the chattel was sold by execution sale.
