Two suits were begun before a justice of the peace of Shelby county. B. Bosenblum instituted a suit against the Bed Top Cab Company, a corporation in which it was alleged that by reason of the gross negligence of defendant in the operation of one of its taxi-cabs on or about the 30th day of November, 1925. Said taxi-cab ran into the automobile of plaintiff and damaged the same to the extent of $191.60. The Bed Top Cab Company instituted a suit before the same justice of the peace against Roscnhlum for $200 for damages to one of its cabs. By consent the two canses were heard together before…
