OPINION OF THE COURT

Rubin, J.

This appeal presents a case in which the permission granted State Police to search a vehicle, found by Supreme Court to be consensual as a matter of fact, represents the product of official coercion as a matter of law. As the Court of Appeals stated in People v Cantor (36 NY2d 106, 112): "Street encounters between the patrolman and the average citizen bring into play the most subtle aspects of our constitutional guarantees.
