This appeal arises out of an action to recover for per*541sonal injuries and property damage resulting from an automobile collision.

In February, 1948, the plaintiff, a resident' of Nickerson, was a patient in a clinic in Kansas City, Mo., undergoing an operation and treatment for a prostate condition. On the morning of February 23, 1948, he, accompanied by his wife and small child, started out in his Buick automobile to visit a relative living west of Kansas City, Kan.
