LOKEN, Circuit Judge.

Justin Davis entered a conditional plea of guilty to possessing marijuana with intent to distribute after his motion to suppress evidence found during a warrant search of his apartment was denied. The search warrant application was based in part on a drug-detection dog’s sniff outside the apartment’s front door. After the motion to suppress was briefed and argued, but before the court ruled, the Supreme Court issued its decision in Florida v.
