This is an indictment charging the defendant with possession of a burglary tool, to wit, a tire iron. The case was tried to a justice of the Superior Court sitting with a jury which returned a verdict of guilty as charged in the indictment. The defendant’s motion for a new trial was subsequently denied by the Superior Court, and he is now in this court prosecuting a bill of exceptions.

It appears from uncontradicted testimony that at approximately 9:20 on the evening of July 21, 1969, the Providence Police Department received a call to the effect that somebody was “breaking in” a market…
