In 1929, Leo Awotin brought an action in the circuit court of Cook county against the Atlas Exchange National Bank of Chicago to recover $35,000 as damages for the bank’s failure to repurchase real estate mortgage bonds, conformably to its agreement made at the time of the sale. Judgment was rendered against Awotin upon a directed verdict.
