This is a petition in equity in which the administrator with the will annexed of the estate of Martha H. Drisko, late of Boston, deceased, seeks instructions as to the distribution of her estate.

The evidence is reported, and at the request of the appellant respondents the judge made a report of the material facts found by him which are in substance as follows: The testatrix died on December 20, 1937.
