MEMORANDUM OPINION

KOLLAR-KOTELLY, District Judge.

The case presents the question of whether Plaintiff Electronic Privacy Information Center (“EPIC”) is entitled to expedited processing of its request for records filed pursuant to the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552 (1996 & West Supp.2004). After consideration of the parties’ cross-Motions for Partial Summary Judgment, their briefs, and the relevant law, the Court determines that Defendant Department of Defense (“DOD”) appropriately denied Plaintiffs request for expedited processing.
