The complaint alleges that Edward E. Claypool was the owner in fee simple, and the Indiana Hotel Company was lessee, in possession under a ninety-nine-year lease, of certain real estate in the city of Indianapolis, Indiana; that in July, 1901, the Indiana Hotel Company entered into a contract with the George B. Swift Company to erect on said real estate a building; that in the same month the Ransome Concrete Fireproofing Company, hereinafter called the Ransome Company, entered into a contract with the George B.
