MEMORANDUM OPINION
THOMAS W. WALDREP, JR., Bankruptcy Judge.
THIS MATTER came before the Court for hearing on May 24, 2007 upon Defendant’s Motion to Dismiss this adversary proceeding pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure on the grounds that the Plaintiffs Complaint (the “Complaint”) fails to state a claim upon which relief can be granted. 1 C.
