Ray Barth appeals from a judgment dismissing his complaint for an injunction and other relief concerning a sinking fund created by the School District of the Monroe Board of Education and dedicated to the construction of a swimming pool. Barth seeks to have the monies declared “funds on hand” and applied to general expenses. The Board seeks to use the funds for present and future capital expenditures other than a swimming pool.
