Porter, J.:

The plaintiff was injured while in the •employ of the defendant as a common laborer, and sued to recover damages. The defendant was operating a steam shovel loading shale upon cars for transportation to its mill. The machine stands upon a surface track like that of a railroad. The track is raised or lowered or shifted from side to side in the shale pit as occasion requires by means of steel jack screws, one at either end of the machine.
