On December 9, 1919, Gilbert Fie-lde-r brought suit in the Franklin circuit court against P. Hansibrough and others to recover damages for false arrest which occurred on June 27, 1918. In, addition to other defenses- the defendants pleaded the one year statute of limitations, and, in connection therewith, alleged that on June 10, 1919, plaintiff filed suit in the Shelby circuit court against the defendants on the same cause of action, and that the Shelby circuit court had jurisdiction of the defendants, and that issue was joined; that on October 9,…
