NEALON, Chief Justice.

Walter Chalmers, appellant herein, as temporary administrator, filed this suit in the district court of the Sixty-first judicial district in and for Harris county, Tex., July 2, 1936. Appellee, American National Insurance Company, was defendant. The object of the suit was to recover the. proceeds .of an insurance policy issued by defendant upon the life of Asencion Arce, who died June 25, 1930, more than five years prior to the filing of this suit.
