This is an appeal from a summary judgment entered in favor of defendant, Continental Oil Company, in a suit filed by plaintiffs, Susanoil, Inc. and Harry Jacobs, seeking damages, actual and exemplary, for alleged fraud in the obtaining by defendant of a unitization agreement for waterflood operations in the Velma (Escondido) Field in Atascoas County, Texas.
