MEMORANDUM OPINION ON DEBTOR’S ELIGIBILITY TO FILE CHAPTER 13

On October 5, 1989, Alice Faye Tomlin-son (“Debtor”) filed a voluntary petition for relief under chapter 13 of the Bankruptcy Code. Her chapter 13 Statement listed total unsecured debts in the amount of $111,415. At the hearing on confirmation of the Debtor’s chapter 13 plan, the chapter 13 trustee objected to confirmation on the grounds that the Debtor was not eligible to file chapter 13 since her unsecured debts exceeded $100,000. 11 U.S.C. § 109(e) limits the availability of chapter 13 relief…
