PREHDERGAST, Presiding Judge.

-Appellant was indicted for the murder of Warren Bullock on January 20, 1914. He was convicted and his punishment assessed at thirty years in the penitentiary.

On the night of January 20, 1914, there was a. dance at the country home of Mr. Spiller. Appellant and deceased both attended it. Bullock was the floor master, or manager of the dance, arid it was his business to collect from each of the young men who danced $1 to pay' for the music, which was the amount charged each one.
