— At the time of the transaction out of which this trial grows, the defendant, William C. Eddon, was a resident of the town of Sprague. He owned a stock ranch about forty miles from Sprague, then in possession of Eddon’s tenant, one Samuel Carlton. The day previous to the shooting Eddon had come to the ranch and remained over night at his tenant’s house. The shooting *293took place early in the morning of the 1st day of July, 1892.
