MEMORANDUM OPINION AND ORDER
HAIGHT, District Judge:
This is an appeal from an order of the Bankruptcy Court for the Southern District of New York, Burton R. Lifland, Judge, dismissing the complaint filed by Kor-vettes, Inc., Debtors and Debtors in Possession (“Korvettes”) and the Official Unsecured Creditors Committee of Korvettes, Inc., et al, Debtors (“Committee”), to set aside and recover a preferential transfer under 11 U.S.C. § 547(b) of the Bankruptcy Code.
