Layton, Chief Justice:

The plaintiffs declared in tort to recover damages for the failure of the defendant to transmit and deliver within a reasonable time a telegraph message.

' The declaration, reduced to its material facts, alleged: that the defendant maintained a telegraph office in Martins-ville, Virginia; that on May 22, 1941, George W.
