The action seeks damages in tort for an alleged illegal expulsion of the plaintiff from the Brotherhood of Railroad Trainmen. On July 16, 1922, charges were preferred against the plaintiff in and before the L. S. Coffin Lodge of which he was a member. Such charges were referred to a committee for hearing and determination. The committee -after a trial reported to the lodge sustaining one of those charges and recommending the expulsion of the plaintiff.
