The plaintiff in error was indicted for killing one L.R. Noe and convicted of murder in the second degree.
Noe was killed May 6, 1927, in the village of Flintville. He was a middle aged man, a respected citizen, and a member of the county court. The plaintiff in error was sixty-seven years of age at the time of the tragedy. He was a physician, having begun the practice of medicine in 1890 in Franklin County, where he remained for about fifteen years.
