—Motion of respondent to dismiss appeal. This is an appeal by the people from a judgment for the defendant on a demurrer to the indictment. (Pen. Code, § 1238.)

Respondent moved to dismiss the appeal on the grounds:—

1. That the notice of appeal is insufficient, ambiguous, and *645unintelligible, in that it purports to have been taken from an order of this and not of the Superior Court, and in that it does not designate the order appealed from with sufficient certainty.

2. That the appeal is from an order sustaining a demurrer, and not from a judgment on demurrer.
