The parties appear in the reversed order from the positions occupied in the trial court, but for convenience we shall hereafter refer to them as they appeared in that court.

Plaintiff, Martha S. Trieschmann, as executrix of the estate of J. Werner Trieschmann, Jr., deceased, filed her petition in the district court of Choctaw county wherein she alleged: her appointment and qualification as executrix; the death of J. W.
