Pending before the court are motions of defendants Triumph Capital Group, Inc. [“Triumph”], Frederick W. McCarthy [“McCarthy”], Charles B. Spadoni [“Spadoni”], Lisa A. Thiesfield [“Thiesfield”] and Ben F. Andrews [“Andrews”] to dismiss numerous counts of the superseding indictment (“indictment”) in this public corruption case.
