Isaac Miller, the plaintiff in error, on a trial in the circuit court of Hancock county, was adjudged guilty of the crime 'of murder in the killing of one James Lake, and has prosecuted this writ of error to obtain a review of the record of his conviction.

Lake came to his death from a pistol shot on June 20, •1903. Miller was then village marshal of the village of Plymouth, in Hancock county. The village had an ordinance prohibiting “rapid and immoderate driving of a horse or a team of horses” in or along the streets or public places within its limits.
