This action was commenced in the district court of Beaver county by the plaintiff, Montgomery Ward & Company, a corporation, as an action for damages. Plaintiff alleges that it had a judgment against one P. H. Kraft which constituted a lien against his land; that the defendant had a mortgage against the same land and started a foreclosure proceeding.
