This ease presents an appeal from the district court of Greer county. The parties will be referred to as they appeared in the lower court. The action was brought by plaintiff to recover from the defendant the value of twelve bales of cotton. The material facts are undisputed. During the year 1928 the defendant was the owner and operator of a cotton gin in the town of Hester, Greer county, Okla., and also engaged in buying and selling cotton, and maintained a cotton yard upon its premises where its own cotton and that of its customers was kept after ginning.
