This appeal is from a judgment in the sum of $722 recovered by appellee, A. A. Hay, plaintiff below, against appellant, W. G. Briley, defendant. Appel-lee’s petition undertook to allege two causes of action — one alternative to the other. One cause of action was for damages for the breach of a warranty of title in the sale of a 172-acre tract -of land; the claim being that 11.83 acres of the tract were in adverse possession of third parties under some claim of title thereto, the nature of which was unknown.
