CHILTON,. J.

This bill was filed by five out of six legatees under the will of Jeremiah Smith deceased,, to have a division of the estate of said deceased made among them', according to the provisions of the will of said testator. The will is exhibited with the bill, from which it appears that the testator directed that all of his estate should be kept together on the plantation on which he then lived, until his youngest child, Burwell Smith, should arrive at the age of twenty-one years, and then the same was to be equally divided among all his children.
