MORROW, Judge.

Appellant’s conviction was for cattle theft, and his punishment was fixed at three years confinement in the penitentiary.

The evidence shows that the owner of the calf in question 'turned it out of a barnyard at night and the next day its hide and a part of the meat were sold by appellant. The State’s theory and testimony was to the effect that the appellant stole the calf and brought it to the residence of P. J. Hoffman, and that he and Hoffman killed, skinned and butchered it. Appellant’s theory and testimony was that he was an employe of Hoffman, who was in the butchering…
