Plaintiffs Robert W. Fisher and Joanne Ferriter have appealed from a judgment of the Superior Court (York County) dismissing a civil action brought by them against defendants Kenneth Dame and Robert Rae-side, and others. The complaint alleged that a series of conveyances of real estate involving defendants constituted the creation of a “subdivision” within the definition of that term in 30 M.R.S.A. § 4956(1), as well as in Art. 3.2 of the so-called “Zoning” Ordinance of the Town of Eliot, and that such subdivision was created in violation of 30 M.R.S.A. § 4956(2)(A) and the…
