WARR1EN, J.

The defendant, in August, 1935, at 8:30 o’clock in the morning, was driving his car north on state trank highway No. 18, in the city of Viborg, Turner county, S. D. At a point in front of the Kellar residence, the defendant’s car struck the plaintiff, a boy I2j4 years old, injuring him quite severely. The plaintiff was engaged -in distributing milk and had hurried from behind a parked car just as defendant drove past.
