This action is brought by plaintiff to recover damages resulting from the death of plaintiff’s intestate upon allegations of negligence of defendant, Rockefeller, Jr. Plaintiff’s intestate was employed by C. G. Gunther’s Sons (hereinafter referred to as Gunther) at 666 Fifth Avenue, borough of Manhattan, New York City. While so employed he fell down an elevator shaft and sustained injuries which resulted in his death.
