OPINION
STAPLETON, Chief Judge:
Before me is one portion of a consolidated action arising out of the construction of an 830,000 square foot addition to the Alfred I. duPont Institute Children’s Hospital in Wilmington, Delaware (the “Project”). Contractual disputes and delays in completing the Project have spawned a complex and entangled thicket of litigation involving numerous parties and millions of dollars in claims.
