On this appeal, we consider a drug conviction entered on a conditional guilty plea. The critical issue is whether a motion to suppress was properly denied.

Facts

On a morning in May 1988, while observing passenger activity at the El Paso International Airport, Border Patrol Agent Charles Diaz noticed an unidentified male enter the airport terminal, check two dark suitcases at the Delta Airline counter, and hurriedly depart. Diaz then proceeded to the Delta baggage area behind the ticket counter and received permission to look among the suitcases for the two checked in by the unidentified man.…
